Astri Keskus Gift Card Terms and Conditions

The gift card is a payment instrument valid in the Astri Group commercial environment and is used to pay for goods or services at a Partner. The gift card can be used multiple times, at one or several Partners, until the Nominal Value of the gift card has been spent or until the Expiry Date.

The Astri Group commercial environment consists of Astri Group shopping centers (hereinafter referred to as the Center), the list of which can be found here.

The owner of the environment Astri.ee (hereinafter referred to as the Online Store) is Astri Internet OÜ, registration code 12555312, located at Lääneringtee 39, Tartu, 50501, email address astri@astri.ee.

These gift card usage rules govern the issuance, circulation, and use of gift cards issued by the Center and the Online Store, and apply to all Clients, Partners, and third parties related to the gift card.

1. Terms

1.1. The Gift Card is an electronic payment card valid in the Astri Group’s commercial environment and is used for payment for Purchases at the Partner’s location up to the Nominal Value.
1.2. The expiration date indicates the last day (inclusive) when the Gift Card can be used at the Partner’s location for payment for Purchases, i.e., the last day of the Gift Card’s validity.
1.3. A Purchase is the acquisition of goods or services from the Partner, paid for partially or fully with the Gift Card. The Issuer is the seller of the Gift Card, i.e., the Online Store or Centre, the list of which is provided here.
1.4. A Reseller is a person authorized by the Centre to sell Gift Cards on behalf of the Issuer and to represent the Issuer in relations with Gift Card Customers.
1.5. A Partner is a person who accepts the Gift Card as a means of payment for goods sold or services provided by the Partner.
1.6. A Customer is an individual, legal entity, or sole proprietor who acquires or uses the Gift Card.
1.7. The Nominal Value is the amount of money the Customer pays for the Gift Card of the same value.
1.8. The Balance is the amount of electronic money on the Gift Card that has not yet been used for Purchases.
1.9. A Device is an electronic payment device, such as a payment terminal or other device used by the Partner to read data from the Gift Card’s magnetic stripe and authorize the purchase.

2. Gift Card Face Value

2.1. The Nominal Value of the Gift Card is determined by the Client, with the minimum Nominal Value being 5 euros and the maximum Nominal Value being 500 euros.
2.2. It is possible to add funds to the Gift Card.

3. Gift Card Sales Locations and Purchase

3.1. The right to issue the Gift Card belongs to the Gift Card Issuer or the Reseller.
3.2. The Gift Card Issuer sells the Gift Card at the Center's information desk and in the Online Store. The Reseller sells the Gift Card at the Reseller's point of sale.
3.3. To purchase a Gift Card, the Customer contacts the Issuer or Reseller at the Gift Card sales location, pays the selected Nominal Value, and fulfills any other stipulated requirements.
3.4. The Issuer or Reseller provides the Customer with a receipt/invoice as proof of payment of the Nominal Value and issues the Gift Card to the Customer.

4. Purchasing a Gift Card from the Online Store

4.1. When placing a Gift Card order, the Customer fills in the required information fields and other details requested by the Issuer in the Online Store, selects the delivery method and payment environment, and clicks the "Secure Payment" button.
4.2. The order is considered final after clicking the "Secure Payment" button.
4.3. The Customer orders the Gift Card to a parcel machine of their choice.

5. Right of Withdrawal

5.1. The Buyer has the right to withdraw from the sales contract concluded in the Online Store within 14 days from the receipt of the order.
5.2. The right of withdrawal does not apply if the Buyer is a legal entity.
5.3. The returned Gift Card must be unused. In order to exercise the 14-day right of return, the Gift Card may not be used in any other way than is necessary to ascertain the nature and properties of the goods, as the Buyer would be allowed to do in a physical store.
5.4. If the Buyer has used the Gift Card for purposes other than necessary to ascertain the nature and properties of the goods, or if there are signs of use or wear on the Gift Card, the Buyer loses the right of withdrawal.
5.5. To return the goods, a withdrawal application must be submitted no later than 14 days after receiving the goods. The withdrawal application must be sent to the email address astri@astri.ee.
5.6. The cost of returning the Gift Card is borne by the Buyer, except in cases where the reason for the return is that the item to be returned does not correspond to what was ordered (e.g., wrong or defective goods). The cost of returning the Gift Card depends on the Buyer's location and the method of return.
5.7. The Online Store will confirm receipt of the withdrawal application to the Buyer by email.
5.8. The Buyer must return the Gift Card no later than 14 days after submitting the withdrawal application or provide proof within the same period that the goods have been handed over to the logistics company.
5.9. Upon receiving the returned Gift Card, the Online Store will promptly refund the value of the Gift Card to the Buyer, but no later than within 14 days. All payments will be made to the Buyer's account from which the Gift Card was paid for. 

6. Use of Gift Card

6.1. Any person who has a Gift Card may use it to make a Purchase.
6.2. A Partner who accepts the Gift Card as a means of payment is not reasonably able to verify whether the Client is the legitimate user of the Gift Card. It is assumed that the Client has the legal basis to use the Gift Card.
6.3. The Gift Card can be used to pay for Purchases in the Astri Group commercial environment at Partners who have accepted the Gift Card as a means of payment.
6.4. The Gift Card is not valid at the following Partners.
6.5. The Gift Card cannot be exchanged for cash or used to purchase another Gift Card.
6.6. Before the Expiry Date, the Gift Card can be used an unlimited number of times at one or more Partners for the payment of goods and services, up to the maximum amount corresponding to the Nominal Value of the Gift Card.

6.7. Before making a Purchase, the Client must inform the Partner of the amount they wish to pay with the Gift Card.
6.8. The Partner does not have the right to refuse to accept the Gift Card as a means of payment, except in the following cases:
a) The device is malfunctioning; b) there is an objective reason for not accepting the Gift Card or a justified suspicion regarding the lack of legal basis for the use of the Gift Card.
6.9. If the Gift Card Balance is not sufficient to pay for the Purchase, the Partner is obliged to accept the Gift Card for payment of the Purchase, provided that the Client pays the remaining amount in cash, by payment card, or with another Gift Card.
6.10. If the Client wishes to pay for the Purchase partially or fully with a Gift Card, they must present the Gift Card to the Partner's employee before payment. The data required for payment will be read from the magnetic stripe of the Gift Card, and the Purchase will be authorized by the Partner’s Device in the presence of the User.
6.11. If the Balance is insufficient to cover the amount requested for Purchase authorization, the authorization will be declined.
6.12. Gift Card authorization is carried out through the payment terminal/cash register system. The Partner will deliver the goods or provide the service only if the Gift Card authorization system confirms the payment with the Gift Card on the payment terminal screen.
6.13. After payment for goods or services, the Gift Card remains with the Client.
6.14. The Gift Card system is managed by Nets Estonia AS at the time of adoption of this edition.

7. Gift Card Expiration Date

7.1 The validity period of the Gift Card is one (1) year from the date of purchase. Each time money is loaded onto the Gift Card, its validity period is extended to twelve (12) calendar months from the date of the latest top-up.

7.2 If the balance of the Gift Card is not 0.00 EUR (zero euros and zero cents) after the Expiry Date, the remaining balance will be cancelled.

8. Checking the Gift Card Balance

8.1 The Client can check the Gift Card Balance: 

8.2 At the Centre's information desk and self-service kiosks; 

8.3 On the Centre's website by logging into their Astri ID account here. 

 

9. Invalid Gift Card 

9.1 A Gift Card is considered invalid if it has at least one of the following characteristics: a) The expiration date has passed; b) The balance is 0.00 EUR; c) The card is damaged; or d) The card is counterfeit or shows signs of forgery. 

9.2 A damaged Gift Card will be replaced with a valid Gift Card in accordance with section 9. 

9.3 A Gift Card is considered counterfeit if it shows signs of forgery.

A counterfeit Gift Card will be cancelled and its user will lose all rights to use the Gift Card from the moment the forgery is detected.  

10. Replacement of Gift Card 

10.1 A Gift Card that has been mechanically damaged and cannot be used for payment of a Purchase may be replaced with a new Gift Card, provided that the card's magnetic stripe is readable or the Balance on the Gift Card can be identified in another way, and the Gift Card's Expiry Date has not yet passed. 

10.2 The customer will receive a new Gift Card with the same Expiry Date and Balance as the card being replaced.

11. Complaints

11.1 All complaints related to the Gift Card must be submitted to the Issuer in writing, indicating the complainant's name, personal identification code, contact phone number and email address, the circumstances of the complaint, and the complainant's claim.  

11.2 All complaints must be submitted to the Issuer within 1 (one) month from the date the circumstances giving rise to the complaint occurred.  

11.3 Complaints submitted after the deadline specified in clause 10.2 will not be reviewed, the refusal to review such complaints cannot be disputed or appealed.  

11.4 The Issuer will review the complaints submitted by the Customer within 10 (ten) working days from receipt of the complaint. 

 

12. Amendment of Gift Card Terms  

12.1 The Issuer reserves the right to make changes to the terms of use of the Gift Card, which will become binding for all Clients, Partners, and third parties related to the Gift Card from the moment the amended terms are published on the Astri.ee website. 

12.2 The terms of use of the Gift Card are published on the Astri.ee website.  

13. Processing of Personal Data

13.1. The processing of personal data is subject to the Privacy Policy.
